1. Introduction

Welcome to Revitalizing Wellness, owned and operated by Rhiannon Neuharth. By accessing or using our website, you agree to comply with and be bound by the following terms and conditions of use. If you disagree with any part of these terms, you may not access the website or use our services.

2. Acceptance of Terms

By accessing or using our website, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. These terms apply to all visitors, users, and others who access or use the website.

3. Services Offered

Revitalizing Wellness provides functional nutrition coaching services, genetic wellness coaching, independent self-study programs, and the GeneWise membership community, all designed to support optimized wellness.

4. Target Audience & Eligibility

Our services are primarily intended for mothers and people with the MTHFR genetic mutation seeking guidance and support for optimizing their wellness journey through functional nutrition and holistic modalities. Our services are intended for individuals 18 years of age or older. If you are under the age of 18, you may only use our services with the involvement and consent of a parent or legal guardian.

5. Membership & Subscription Services

Certain services, including the GeneWise membership community, are offered on a recurring subscription basis. By enrolling in a subscription service, you authorize Revitalizing Wellness to charge your chosen payment method on a recurring basis (e.g., monthly) until you cancel in accordance with this section.

To cancel a subscription, you must email [email protected] and provide at least 30 days' notice before your next billing date. Your subscription will remain active, and you will continue to be billed, until the 30-day notice period has elapsed. No partial refunds are issued for the notice period or any unused portion of a billing cycle.

Unless otherwise stated at checkout, subscription fees are non-refundable once a billing cycle has begun.

6. Payment and Refunds

We do not offer refunds or guarantees for our one-time coaching packages or products. All coaching packages must be used within 90 days of purchase unless otherwise specified. For subscription and membership services, see Section 5 above.

Digital products. All digital products — including but not limited to guides, courses, mini-courses, meal plans, journals, and other downloadable or web-based content — are sold as-is and are non-refundable once access has been granted or the file has been delivered. Digital products are licensed for your personal use only. You may not share, resell, redistribute, forward, post, or otherwise make available any digital product or its contents to any third party, in whole or in part, without our prior written permission.

7. Intellectual Property

All content, materials, and resources provided on Revitalizing Wellness are the intellectual property of Rhiannon Neuharth and are protected by copyright laws. Reproduction or distribution of any content without prior written permission is strictly prohibited.

8. User Comments, Feedback, and Other Submissions

If, at our request, you send certain specific submissions, or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, "comments"), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any comments that you forward to us. We are under no obligation to (1) maintain any comments in confidence, (2) pay compensation for any comments, or (3) respond to any comments.

We may, but have no obligation to, monitor, edit, or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, obscene, or otherwise objectionable, or that violates any party's intellectual property or these Terms.

You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, or other personal or proprietary right, and will not contain unlawful, abusive, or obscene material, or any computer virus or other malware. You may not use a false email address or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy.

9. Optional Tools

We may provide you with access to third-party tools over which we neither monitor nor have any control. We provide access to such tools "as is" and "as available," without any warranties, representations, or endorsement, and shall have no liability arising from your use of them. Any use of optional third-party tools offered through the site is entirely at your own risk and discretion, and you should review the terms of the relevant third-party provider. We may, in the future, offer new services and features through the website, which will also be subject to these Terms.

10. Disclaimer of Liability

Nature of services. Revitalizing Wellness provides functional nutrition coaching services and independent study programs designed to support optimized wellness, tailored primarily for mothers and individuals with the MTHFR genetic mutation.

Not professional medical advice. The information provided on Revitalizing Wellness is for informational purposes only and is not intended as medical, nutritional, or wellness advice. Our content and services are not intended to diagnose, treat, cure, or prevent any disease. Users should always consult with a qualified healthcare provider before making dietary or lifestyle changes.

Limitation of liability. Revitalizing Wellness and Rhiannon Neuharth shall not be held liable for any errors, omissions, or damages arising from the use of our website, content, or services. Engaging in dietary or lifestyle changes based on information obtained from our website is done at your own risk.

You agree to indemnify, defend, and hold harmless Revitalizing Wellness and its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

12. Termination

These Terms are effective unless and until terminated by either you or us. You may terminate at any time by notifying us that you no longer wish to use our services, or by ceasing to use the site.

If, in our sole judgment, you fail — or we suspect you have failed — to comply with any term of these Terms, we may terminate this agreement at any time without notice, including for reasons such as breach of these terms, non-payment, or misuse of our services. You will remain liable for all amounts due up to and including the date of termination, and we may deny you access to our services. Obligations and liabilities incurred prior to termination survive termination of this agreement.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be severed. Such a determination shall not affect the validity and enforceability of any remaining provisions.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms, along with any policies or operating rules posted on this site, constitute the entire agreement between you and us and govern your use of our services, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

15. Governing Law & Jurisdiction

This website and these Terms are governed by the laws of Volusia County, Florida, USA. Any disputes arising from your use of this website or our services shall be subject to the exclusive jurisdiction of the courts located in Volusia County, Florida.

16. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
